The petitioner seeks bail in Chiksaura P.S. Case No. 60/2015, registered for the offences punishable under Sections 363, 365 of the Indian Penal Code and later on 376(G) of the Indian Penal Code was added.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 13.12.2016, but thereafter similarly situated co-accused Alok Kumar Suman @ Ramesh Chaudhary was granted bail by a coordinate bench of this court vide order dated 12.05.2017 passed in Cr. Misc. 15961/2017. It is submitted that six days after the occurrence the case was lodged, but from perusal of the statement
Patna High Court Cr.Misc. No.34269 of 2017 (3) dt.16-08-2017 2/2 of the victim itself, it appears that the victim alleged that the petitioner and others kidnapped her and committed gang-rape. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
