The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 504, 506, 419, 420, 467, 468, 469, 471, 120B/34 of the Indian Penal Code. As per the prosecution case, a forged Hibanama was created by co-accused Shahin Raza in the name of Mumtaz Naar and this petitioner and co-accused Md. Sikandar Raza were the witnesses of said Hibanama.

It is submitted on behalf of petitioner that petitioner is neither vendor nor purchaser. From perusal of the F.I.R., it is apparent that so called Hibanama was fraudulently created by co-accused Shahin Raza in the name of Mumtaz Naar and petitioner is only witness to the said Hibanama. Petitioner has got clean antecedent.

Considering the nature of allegation and clean antecedent, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Kotwali P.S.
