JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-02-2018 Heard learned counsel for the petitioners and the learned counsel for the State.

This application has been filed by the petitioners for modification in the order dated 07.11.2017 passed in Criminal Misc. No. 51849 of 2017 by this court with regard to extend the period of surrender of the petitioner in the court below. Learned counsel for the petitioner submits that vide order dated 07.11.2017 passed in Criminal Misc. No. 51849 of 2017, the petitioners were granted anticipatory bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.6518 of 2018 (2) dt.07-02-2018 amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sherghati at Gaya, in connection with Sherghati (Dobhi) P.S. Case No. 318 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. But the petitioner could not surrender within the stipulated period due to personal difficulties. In that view of the matter, learned counsel for the petitioner prays for extension of period of surrender of the petitioner in the court below.

Considering the submission of the learned counsel for the petitioners, the period of surrender of the petitioners in connection with the aforesaid case in the court below is further extended for four weeks from today and this applications is, accordingly, allowed with the aforesaid modification in the order dated 07.11.2017 passed in Criminal Misc.
