The petitioner seeks bail in a case registered under Sections 304B, 379/34 of the Indian Penal Code. Allegation against the petitioner is of committing torture and caused death of the victim due to non-fulfillment of demand of dowry.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 04-09-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. For a petty reason, a dispute took place between the family members. The deceased is said to have
Patna High Court CR. MISC. No.14411 of 2019(6) dt.22-08-2019 2/2 committed suicide as the same is evident from paragraphs 23, 24, 25, 39, 40 & 41 of the case diary. No offence u/S 304B of the Indian Penal Code is made out.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-Ist, Araria in connection with Sessions Trial No. 271 of 2018 arising out of Jokihat P.S. Case No. 210 of 2012.
