Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Kanti P.S. Case No. 62 of 2020 registered for offences under Sections 457 and 380 of the Indian Penal Code. It is submitted that the alleged item recovered from the house of the petitioner is commonly available in the market and there is no material to prove that item which was recovered from his house is stolen item.

Considering the aforesaid submission and considering the fact that the petitioner has no criminal antecedent, this

Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur in connection with Kanti P.S. Case No. 62 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
