The petitioner seeks regular bail in connection with Katihar Nagar Sahayak P.S. Case No. 314 of 2020 instituted for the offences under Sections 341, 323, 324, 307, 427, 504 and 34 of the Indian Penal Code read with Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is in custody since 27.11.2020, he is a person with clean antecedent and charge-sheet has been submitted. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that it is alleged against the petitioner that he assaulted the informant by means of a sword on the head. It has further been submitted that the injury is simple in nature.

Patna High Court CR. MISC. No.25719 of 2021(2) dt.18-11-2021 2/2 Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that from perusal of the impugned order it would manifest that the blow was repeated and one was on the vital part of the body and the size of the injury is also mentioned. On query of the Court that the impugned order does not disclose the nature of injury, the learned A.P.P. fairly submits that the order is silent with respect to the same.

Considering the fact that the petitioner is in custody since 27.11.2020, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing of bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Katihar Nagar Sahayak P.S. Case No. 314 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
