The petitioner apprehends her arrest in connection with Parsa Bazar P.S. Case No. 149 of 2015, registered under Section 304B/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The accusation is of killing the sister of the informant by her husband in in-laws due to non-fulfillment of demand of dowry and also to dispose of her dead body.
Learned counsel for the petitioner submits that petitioner is married 'Nanad' of the deceased, sister of the informant, and she has been implicated in his case with general allegation of making demand of dowry. It is further submitted that
Patna High Court Cr.Misc. No.16546 of 2017 (2) dt.13-07-2017 co-accused, Ruby Devi @ Anjana, who is also married 'Nanad' of the deceased, has already been granted privilege of anticipatory bail by a Bench this Court vide order dated 28.03.2017 passed in Criminal Misc. No. 12412 of 2017.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of then Chief Judicial Magistrate, Patna, in connection with Parsa Bazar P.S. Case No. 149 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
