JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-07-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Chainpur P.S. Case No. 321 of 2019, disclosing offences under Sections 341, 323, 307, 354, 379 and 34 of the Indian Penal Code.

At the very outset, learned counsel appearing on behalf of the petitioner has submitted that for the occurrence taken place on the same date and time, a counter case has also been filed in which the informant is an accused. He has further submitted that the informant side and the petitioner are agnates and co-villagers. In relation, to certain internal dispute some scuffle might have taken place in between the parties. Patna High Court CR. MISC. No.13158 of 2020(2) dt.10-07-2020 2/2 wife with lathi and axe, is exaggerated version of the occurrence. Referring to the injury report, learned counsel for the petitioner has submitted that all the injuries have been found to be simple in nature.

Considering the above submission made on behalf of the petitioner, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 321 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
