The petitioner is in custody in connection with Jagdishpur P.S. Case No.219 of 2017, a case under Sections 363/366A of the Indian Penal Code.

The petitioner is not named in the F.I.R. The F.I.R. named accused is suspected to have kidnapped to the granddaughter of the informant. The victim girl in her statement under Section 164 Cr.P.C. disclosed her age as 19 years and leveled allegation against co-accused Rajesh Kumar to have forcefully ravished her.

Considering the fact that there is no allegation against the petitioner in the statement of the victim, let the

Patna High Court Cr.Misc. No.6702 of 2018 (2) dt.05-02-2018 P2/ petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
