JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks bail in connection with C2/336/17 registered for offences punishable under section 30(A) of Bihar Excise Act.

Allegation against the petitioner is that about 41 litres of Fulli Soufiwhe was recovered from the possession of the petitioner.

Learned counsel for the petitioner submitted that he has falsely been implicated in this case and having no criminal antecedent and he is in custody for about three months. Heard learned A.P.P. also.

Having heard both sides and considering the aforementioned facts and circumstances, let petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/-

Patna High Court Cr.Misc. No.34867 of 2017 (2) dt.03-08-2017 with two sureties of the like amount each to the satisfaction of the A.D.J.-II, Sitamarhi, in P.S. Case No. C2/336/17, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not adduce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
