JUSTICE ARUN KUMAR ORAL ORDER 09-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 27.11.2017, seeks bail in Madhepura PS Case No. 750 of 2016 registered under Sections 341, 323, 325, 307, 379, 427 and 34 of the IPC.
The allegation in brief is that the petitioner and other accused came to the informant's shop and took him to his sister's village but on the way they assaulted him with piece of brick.. Learned Counsel for the petitioner submits that the injury to the informant was caused due to accident as he fell down from the motorcycle and sustained injury on the face, the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Santosh @ Santosh Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Madhepura in connection with Madhepura PS Case No. 750 of 2016.
