JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 6.9.2017 passed in Cr.Misc.No.40857 of 2017.

It appears that the victim girl has named this petitioner and other accused persons in a case of kidnapping. Submission of learned counsel for the petitioner is that victim has named this petitioner and other co-accused persons and two of them have been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 12.9.2017 passed in Cr.Misc.No. 39177 of 2017 and petitioner is in custody since 25.5.2017.

Having heard both sides and in view of the fact that two

Patna High Court Cr.Misc. No.38581 of 2018 (2) dt.04-07-2018 2/2 co-accused have been granted anticipatory bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Kishanganj, in connection with Special (POCSO) Case No. 19 of 2017, arising out of Kishanganj P.S.case No. 204 of 2017, G.R.No. 680 of 2017, on the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
