JUSTICE SUDHIR SINGH ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302, 201/34 of the Indian Penal Code. The case has been registered on the basis of fardbeyan of the informant given before S.I. of Chhatarpur Police Station and allegation is that the petitioner and other co-accused in conspiracy with each other committed the murder of her husband on account of land dispute. It is further alleged that accused persons had given threaten ten days earlier to her husband of dire consequence. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that he has been made accused merely on suspicion. There is no eye witness to the occurrence.
On behalf of the State, it is submitted that the petitioner

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Supaul in connection with Chhatarpur P.S.Case No. 247 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
