The petitioner apprehends his arrest in a case under Sections 447, 341, 323, 324, 307, 504, 34 of the Indian Penal Code.

The petitioner is alleged to have assaulted the informant with Farsa on her head. It is submitted that simple injury was caused. The police submitted chargesheet under Section 308 of the Code of Criminal Procedure. The police also granted the privilege of Section 41(1)(proviso) of the Code of Criminal Procedure. Two other accused persons have been granted anticipatory bail by the learned Sessions Judge, but it appears that it was the petitioner, who assaulted the informant with Farsa on his head and the petitioner moved for anticipatory bail only after four years of the occurrence instead of appearing before the court

Patna High Court Cr.Misc. No.14274 of 2016 (2) dt.20-04-2016 2/2 after getting the privilege of Section 41(1) proviso of the Code of Criminal Procedure.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Bela P.S. Case No. 69 of 2012. Accordingly, the same is rejected.
