JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This application, for grant of anticipatory bail, arises out of Baikunthpur P.S. Case No. 280/18, disclosing offences under Sections 414/34 of the Indian Penal Code and Section 37(B) of the Bihar Prohibition & Excise Act, Amended, 2016. Police on information that some miscreants in drunken condition are creating nuisance and had kept three stolen motorcycles, raided the place and arrested two persons and other two succeeded in fleeing away and the apprehended persons disclosed the names of petitioner and one accused Ram Babu Rai and police also recovered three motorcycles. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and has no criminal antecedent and he has been named in this case by the co-accused, however, nothing has been recovered from the

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj, in connection with Baikunthpur P.S. Case No. 280/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Vinod Kumar Sinha, J) sunilkumar/- U T
