2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 190, 191(2), 115(2), 126(2), 303(2), 304(2), 109 and 132 of BNS.
3. The case of the prosecution is that the informant along with police officials seized a motorcycle without number plate. In the meantime, co-accused Abhay Yadav and Matendra Kumar came out for the release of the said motorcycle, the informant was not ready for releasing the seized motorcycle. Thereafter, accused persons went to the shop of Champaran Meat House and came along with 13-14 persons including the
Patna High Court CR. MISC. No.16197 of 2025(2) dt.11-04-2025 2/3 petitioner and attacked the three constables and co-accused Abhay Yadav and Matendra Yadav snatched their pistol. It is further alleged that the petitioner and co-accused Lallu Samrat snatched the mobile phone.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. There is no specific allegation against the petitioner. He is only the member of the mob. It has also been submitted by learned counsel for the petitioner that similarly situated other co-accused person has already been granted bail by learned co-ordinate Bench of this Court vide order dated 21.03.2025 in Cr. Misc. No. 13976 of 2025. Moreover, the petitioner is languishing in judicial custody since 14.12.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jagdishpur P.S. Case No. 425 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount
