The petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 342, 323, 405 of the Indian Penal Code and 3⁄4 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. It is alleged that on protest being made for throwing mud due to rash driving, the complainant was being abused by calling caste name and she was arrested at the Police Station.

It is submitted by the learned counsel for the petitioner that during investigation, acquisition has been found

Patna High Court Cr.Misc. No.19363 of 2015 (2) dt.29-04-2015 false and final form was submitted which was accepted and thereafter the protest-cum-complaint case was filed. Considering the fact that the accusation was not found true during investigation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikharana, East Champaran in connection with Protest-cum-Complaint Case No. C291 of 2012, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
