Heard learned counsel for the parties.

This application for anticipatory bail arises out of Sonpur P.S. Case No. 516 of 2018 for the offence under Sections 419, 420, 467, 468 and 471/34 of the Indian Penal Code.

The petitioner is a practicing Advocate of this Court and has been made accused. It is alleged in the First Information Report, which is based on a letter of the Circle Officer, Sonepur, that one Surendra Prasad had submitted three correction slips in a mutation matter in the name of one Sunil Kumar Khemka, which was found to be forged. Upon enquiry, the said Surendra Prasad informed that Sunil Kumar Khemka had given him the documents and money through this petitioner.

Patna High Court CR. MISC. No.14712 of 2019(3) dt.14-03-2019 2/2 It has been argued on behalf of the petitioner that over and above the so-called disclosure made by the co-accused Surendra Prasad, there is no material against the petitioner for his implication.

Considering the nature of accusation and submission advanced on behalf of the petitioner, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Saran in Sonpur P.S. Case No. 516 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
