Patna High Court CWJC No.4319 of 2022(2) dt.05-05-2022 2/3 Case No. 10/2018 whereby and whereunder the Petitioner has been directed to pay the Gratuity amount of Rs.177600/- including interest to Respondent No. 5.

b) For issuance of appropriate writ(s)/order(s)/ direction(s) for staying the operation of certificate proceeding qua Respondent no. 5 bearing Certificate Case No. 03/2019-20 and for quashing the entire certificate proceeding pending against the petitioner pursuant to the abovesaid order dated 22.12.2018 whereby and where under petitioner has been directed to pay Rs.182206.50/- as final payment in the Certificate case vide its order dated 10.07.2019.

c) For issuance of appropriate writ(s)/order(s)/ direction(s) to stay the operation of all the impugned payment Orders until the disposal of this writ application.

d) For issuance of appropriate writ(s)/order(s)/ direction(s) to pass such other order(s), direction(s) to which Petitioner may be found entitled in the facts and circumstances of the instant case."

After the matter was heard for some time, finding the Court not in favour of the submissions made by the learned counsel for the petitioner, learned counsel for the petitioner, under instructions, states that the petitioner shall be content if the petition is disposed of, with liberty to initiate appropriate

Patna High Court CWJC No.4319 of 2022(2) dt.05-05-2022 3/3 proceedings before the appropriate forum, including filing of an appeal, and to take recourse to such other alternate remedies which are equally efficacious in law.

Prayer allowed.

Since the petitioner has been pursuing remedies before this Court, the issue of limitation shall not be allowed to come in the way, more so in view of the current pandemic Covid-19.

The petition is disposed of as withdrawn with the liberty aforesaid.

Interlocutory application(s), if any, shall also stand disposed of.
