2. This criminal appeal has been filed against the order dated 07.11.2023 passed by learned Additional District & Sessions Judge I-cum-Special Judge SC/ST (POA), Kaimur at Bhabua in ABP No. 1358 of 2023 arising out of Durgawati P.S. Case No. 293 of 2023, registered under Sections 363, 341, 342, 376, 328, 504, 506/34 of the Indian Penal Code and Section 3(1) (r)(s)(iv) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby the prayer for anticipatory bail of appellant has been rejected.
3. As per F.I.R., this appellant is alleged to have
Patna High Court CR. APP (SJ) No.1060 of 2024(6) dt.24-11-2025 2/2 committed rape upon the daughter of respondent no. 2 on the point of pistol. It is further alleged that appellant also prepared video of the same and threatened to make the video viral. When respondent no. 2 and her husband went to the house of appellant to talk to his father, they were abused by caste name. Victim in her statement, recorded under Section 164 Cr.P.C., has supported the prosecution story.
4. Considering the gravity of accusation and statement of the victim recorded under Section 164 Cr.P.C., I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail, is hereby rejected.
