2. The petitioner apprehends his arrest in connection with Farbisganj (Simraha) P.S. Case No. 1070 of 2023, registered for the offences punishable under Sections 379, 411, 413, 414/34 of the Indian Penal Code.
3. As per allegation, on the tip off, the informant along with police personnel raided the place of occurrence and found some boys climbing on the electric pole, who were cutting the wire and some boys are collecting the wire. Having seen the police vehicle, a red color vehicle was ran away. Some boys were apprehended, who named as Ananat Kumar, Suman Kumar Mushan Mandal and Niraj Kumar. Five bundles wire and a cutter machine was recovered from possession of apprehended accused persons.

4. The learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. He is a person of clean antecedent. He was neither arrested nor any incriminating articles was recovered from his possession. His name has been figured in the confessional statement of co-accused, who has been arrested at the spot.
5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Farbisganj (Simraha) P.S. Case No. 1070 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
