NILU AGRAWAL ORAL ORDER 02-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

This modification application has been preferred for modification of the order dated 04.07.2017 passed in Cr. Misc. No. 25351 of 2017 by which petitioner was granted bail in connection with Khirimore P.S. Case No. 18 of 2015 pending in the Court of learned Additional Chief Judicial Magistrate-III, Danapur, Patna subject to the condition that one of the bailors would be a close relative of the petitioner, who would have sufficient immovable properties within the jurisdiction of the concerned Police Station and who will file an affidavit indicating his relation with the petitioner.

Learned counsel for the petitioner submits that he is ready to comply with the aforesaid condition, but the bailor does

Patna High Court Cr.Misc. No.36604 of 2017 (2) dt.02-08-2017 2/2 not belong to Khirimore P.S. rather he belongs to Masaurhi P.S. within the district of Patna.

Under such circumstances, let the lines "who would have sufficient immovable properties within the jurisdiction of the concerned Police Station" be deleted. The order dated 04.07.2017 passed in Cr. Misc. No. 25351 of 2017 is modified to the extent indicated above.
