This application for anticipatory bail arises out of Tekari P.S. Case N0. 147 of 2018, disclosing offences under Sections 147, 148, 149, 323, 341, 342, 353, 307, 379, 186, 504,506 of the Indian Penal Code.
Allegedly, the persons named in the F.I.R, 25 in number and several other persons were protesting against the road accident, leading to death of a person became of which vehicular traffic came to it and still, on interception by the police, they abused them also and said to have assaulted them.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.24393 of 2019(2) dt.17-04-2019 2/2 petitioners has submitted that the allegation against all the persons named in the First Information Report is general and omnibus and in similarly circumstanced, co-accused persons have been granted anticipatory bail by this Court in Cr. Misc. No. 12901 of 2019 by order dated 05.03.2019. Considering the above submission, this application is allowed.
Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-VI, Gaya in Tekari P.S. Case No. 147 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
