Heard the parties.

Petitioner seeks bail in a case registered for the offences punishable under Sections 406,419,420,467,468,471 of the IPC and Section 7 of the Essential Commodities Act. Rice was recovered from a Truck and it is alleged that the commodity was for distribution under PDS Scheme. Submission is that the rice is not a controlled item nor it is established that the same was for "under what scheme" of the Government. Petitioner is in custody since 06.01.2021. Considering the nature of material and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand)

Patna High Court CR. MISC. No.27507 of 2021(2) dt.04-10-2021 2/2 with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Khajauli P.S.Case No.238 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
