This is an application for regular bail in connection with Bela P. S. Case No. 106 of 2017 registered for the offences punishable under Sections 363, 366A r/w 34 of the Indian Penal Code.
Informant is mother of victim girl who in her statement has stated that her minor daughter Priyanka Kumari had gone outside to attend call of nature and thereafter she did not return. Petitioner and other accused had kidnapped her daughter to get her married with petitioner. The girl had been recovered and her statement under Section 164 Cr. P.C. has been recorded in which she has stated that she had gone with petitioner with her own sweet-will and volition and has denied her forcible abduction. The girl has stated her age to be 17
Patna High Court Cr.Misc. No.14015 of 2018(3) dt.06-04-2018 2/2 years. Medical Board has found her age to be 15 to 17 years. The incident took place on 11.4.2017. Petitioner has no criminal antecedent and he is in custody since 14.4.2017. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ADJ-Ist cum Special Judge Children Court, Sitamarhi, in connection with Bela P.S. Case No. 106 of 2017.
