The petitioner seeks bail in Special Case No.12339 of 2018 arising out of Patna Junction (Rajednra Nagar) P.S.Case No.478/18 registered under Section 273 of I.P.C.and Section 30(a) of the Bihar Prohibition and Excise Act. The allegation is of recovery of 24 litres 300 ml.liquor kept in the bag of the petitioner.

It has been submitted on behalf of the petitioner that the the petitioner is innocent and has been falsely implicated in this case. He is in custody since 30.12.2018. Petitioner has got no criminal antecedent.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of

No.14291 of 2019(2) dt.14-03-2019 2/2 the like amount each to the satisfaction of Special Judge, Excise, Patna, in Special Case No.12339/18 arising out of Patna Junction (Rajendra Nagar) P.S.Case No.478 of 2018 subject to the conditions that (i) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned. (ii) petitioner/s shall co-operate in the trial and shall be represented on each and every date fixed by the court. (iii) if the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner/s.
