2. The present petition has been preferred for restoration of F.A. No. 127 of 2017 which was dismissed for non-prosecution 23.4.2018.

3. In view of the statement made in paragraphs 4 and 5 of the petition, the MJC No. 575 of 2023 is allowed subject to payment of Rs.500/- with the Patna High Court Legal Services Committee.

4. The First Appeal No. 127 of 2017 is restored to its original file subject to payment of the amount as stated above.

5. The appellant will be complying the original order

Patna High Court MJC No.575 of 2023(4) dt.25-07-2024 2/2 dated 17.1.2018 in next four weeks failing which this application shall stand rejected without further reference to a Bench.
