The petitioner, already in custody, seeks bail in connection with Mufassil Khagaria P.S.Case No. 274 of 2017 registered under Sections 302,307, 120B and 506/34 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that two other accused persons caught hold the informant's brother, thereafter petitioners shot at him and he succumbed to injury.

Submission is that petitioner is the step brother of the deceased and has falsely been implicated due to property dispute and the brother of the informant was first brought to his house thereafter police reached there but no such information was lodged.

Whereas learned counsel for the State submits that instantly police reached to the hospital and there FIR was

Having considered the specific accusation against the petitioner, the prayer of bail of the petitioner is rejected. Trial court is directed to expedite the trial and conclude the same preferably within a year.
