JUSTICE RAVI RANJAN ORAL ORDER 10-08-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offences under Section 120B of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. It is contended that as per allegation, 75 litres of foreign liquor and 340 litres of country-made were recovered from the tempo which was being boarded by the petitoners. Petitioners claim that they are having clean antecedent and are in custody since 29.05.2017.

Considering the facts and the circumstances of the case, the petitioners, abovenamed are directed to be released on

Patna High Court Cr.Misc. No.36570 of 2017(2) dt.10-08-2017 2/2 bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Gaya in connection with Bodh Gaya P.S. Case No. 336 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.

However, at the time of furnishing bail bonds, the court below will verify and assure itself regarding the criminal antecedent of the petitioners. If the petitioners are having clean antecedent then their bail bonds would be accepted otherwise they would not be released on bail.
