JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2015 Heard learned counsels for the petitioners and the State. The petitioners being parents of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B,201 and 120B of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after six and half years of marriage for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioners that in fact the marriage was performed in 2006 but the victim was suffering from Hepatitis B since 2008. The medical reports to that effect have been brought on record as Annexure 3 series but

Patna High Court Cr.Misc. No.21411 of 2015 (2) dt.23-06-2015 2/2 subsequently when the victim was referred to PMCH, she died on way. The complaint was lodged after five days of the occurrence when the accused persons refused to give minor child of the victim to the informant.

Considering the delayed lodging of the case, the petitioners being aged persons and unmarried sister of the husband of the victim, the accusation not being specific against the petitioners and the medical report reflects that the victim was suffering from ailment since several years, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Kartahan P.S. Case No. 88 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
