ANJANA MISHRA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the Bihar State Food and Civil Supplies Corporation Limited as well as learned Additional Public Prosecutor for the State.
This Court, vide order dated 15.09.2015, had directed the petitioner to deposit 20% of the alleged defalcated amount within a period of six months. More than six months have passed and only a paltry amount of rupees three lacs has been deposited by the petitioner.
Learned counsel for the petitioner submits that he was prevented on account of unforeseen circumstances from depositing the rest amount and, therefore, prays for a further extension of time for depositing the rest amount.
Patna High Court Cr.Misc. No.14379 of 2016 (2) dt.27-04-2016 P2/2 Considering all facts and circumstances, this Court, while taking a lenient view, is granting a further extension of four months from the date of receipt/production of a copy of this order. It is thus directed that the petitioner shall positively deposit the rest amount which remains of the 20% so directed to be deposited within the aforesaid period.
In case, the petitioner does not deposit the same for any reason, the order dated 15.09.2015 shall stand automatically recalled.
The order dated 15.09.2015 is modified to the said extent. (Anjana Mishra, J) Saif/- U T
