Petitioner seeks bail in connection with Bela P.S. Case No. 99 of 2017 for offences punishable under Sections 363, 366, 376, 494 of the Indian Penal Code.

The complaint case, as lodged by the complainant, which was registered as First Information Report under Section 156(3) Cr.P.C., is that his daughter was married in Nepal and while going from her maike to sasural, some persons including the petitioner had kidnapped the informant's daughter for illicit purposes.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.48277 of 2017 (3) dt.19-12-2017 2/2 petitioner that he is innocent, bears no criminal history and now they are wedded wife and husband. The victim girl also in her statement under Section 164 Cr.P.C. has stated that she has married the petitioner without any duress. He further submits that the age of the victim girl has been assessed by the Magistrate as of 20 years and petitioner is languishing in judicial custody since 22.07.2017.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Bela P.S. Case No. 99 of 2017.
