This is a case registered under sections 379 and 411 of the Indian Penal Code.

The allegation against the petitioner is that when the informant woke up he noticed that his motorcycle parked on the door was missing. It has been further alleged that informant received information that the same motorcycle had thereafter been recovered by the police.

Counsel for the petitioner submits that the petitioner is next door neighbour of the informant and he has falsely been implicated in this case due to some altercation between both the

It has been further submitted that from perusal of the seizure list which has been annexed, it is obvious that it is the informant himself who had handed over the motorcycle. Prior to the instant case there is no criminal antecedent against the petitioner and he is in custody since 20.02.2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, Vaishali at Hajipur in connection with Patepur P.S.
