JUSTICE ARUN KUMAR ORAL ORDER 13-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Karanday P.S.Case No. 57 of 2016 registered under Sections 395 and 397 of the Indian penal Code.
Allegation in brief is that informant's truck was overtaken by another vehicle and miscreants snatched Rs. 3000/- from him as well as mobile from him.
Submission is that FIR is against unknown and in the confessional statements of co-accused Saurav Kumar and Abhimanyu Kumar, names of these petitioners came as accomplice, except that there is no other material, neither any incriminating articles were recorded from their possession nor put on TIP and charge sheet has been submitted and Saurav Kumar and Abhimanyu Kumar, who disclosed the names of the
Patna High Court Cr.Misc. No.8600 of 2018 (2) dt.13-02-2018 2/2 petitioners, have been admitted to bail by a co-ordinate Bench of this Court vide order dated 20.09.2017 passed in Cr. Misc. No. 42558 of 2017 and vide order dated 28.11.2017 in Cr. Misc. No. 56293 of 2017.
Having considered the aforesaid facts and circumstances, the petitioners, namely , Vikash Kumar and Shishupal Kumar, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. Radhey Shyam, J.M. 1st Class, Sheikhpura, in connection with Karanday P.S.
