JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-01-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest for the offences alleged under Section 366/34 of the Indian Penal Code, registered in connection with Bahadurpur P.S.Case No. 146 of 2019.

The informant Ravindra Singh lodged the FIR that he was residing in a rented premises for eight years in Navtolia P.S. Bahadurpur. His landlord is co-accused Ishwar Singh. It has been alleged in the FIR that his 17-year-old daughter was traceless and it was firm belief of the informant that co-accused persons named in the FIR had kidnapped his daughter with intent of marriage.

From perusal of the order of the learned court below, it appears that the victim was recovered and her statement under Section 164 of the Cr. P.C. was recorded. The victim herself stated her age less than 18 years. She has further stated that she was brought in Rajasthan and her marriage was solemnized forcibly with the present petitioner.

Considering the allegation against the petitioner, in my view, it is not a fit case for anticipatory bail. The prayer for anticipatory bail on behalf of the petitioner is hereby rejected. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
