The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 324, 323, 325, 307, 354(B), 379 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that petitioner had earlier moved this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 83674 of 2023 but the same was permitted to be withdrawn by an order dated 08.04.2024. It is next submitted that this is the second anticipatory bail application filed on behalf of the petitioner on the ground that the injury suffered by the injured has been

Learned A.P.P. for the State at this stage submits that Criminal Miscellaneous No. 83674 of 2023 was permitted to be withdrawn by an order dated 08.04.2024. It is further submitted that the earlier anticipatory bail application was withdrawn not on the ground of injury. It is further submitted that after more than two years of withdrawal of Criminal Miscellaneous No. 83674 of 2023, the second anticipatory bail application has been filed on the ground that the injury report dated 16.12.2024 opined the injury to be simple in nature.

The learned APP further submits that from 08.04.2024 till 16.12.2024, the petitioner did not move before a Superior Court against the said order nor surrendered rather it appears he was trying to manipulate the injury report. It next submitted that the injury report is dated 16.12.2024 i.e. the injury report came after eight months of withdrawal of Criminal Miscellaneous No. 83674 of 2023. It is thus submitted that petitioner appears to be a fence sitter.

Considering the submissions made by the learned APP, the Court is not inclined to entertain the second anticipatory bail application.
