The petitioners, in the present case, are seeking anticipatory bail in connection with Magadh University P.S. Case No. 133/2017 registered for the offences under Section 341, 323, 554, 307, 504, 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that from perusal of the first information report itself it would appear that there was no allegation of assault against these petitioners. The allegation of assault has been specifically attributed to other accused who are not before this court. Learned A.P.P. for the State is present and has

Patna High Court CR. MISC. No.14281 of 2019(2) dt.11-03-2019 2/2 opposed the prayer for anticipatory bail of the petitioner but accepts to the extent that there is no allegation of causing any injury against these petitioners.

In the given facts and circumstances of the case where there is no specific allegation of assault against these petitioners and further that these petitioners are having clean antecedent, in the event of their arrest/surrender in the court below within a period of four weeks from today, let the above-named petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like each to the satisfaction of learned A.C.J.M. - IX, Gaya, in connection with Magadh University P.S. Case No. 133/2017, subject to condition that petitioners will join investigation by reporting to the Investigating Officer within a period of two weeks from today and will cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
