From reading of the FIR, it appears that the petitioner was actively involved in the commission of the murder of the son of the informant. He along with other co-accused(s) surrounded him and indiscriminate assault was made by sharp cutting weapon. Further allegation is that petitioner also fired at the deceased resulting in his death.

Contention of the petitioner is that there is no fire arm injury found on the person of the deceased.

Considering the allegation and the criminal antecedents of

Patna High Court Cr.Misc. No.47405 of 2017(2) dt.17-10-2017 2/2 the petitioner as set out in para 3, this Court is not inclined to allow the application. Prayer for bail is, accordingly, rejected. (Kishore Kumar Mandal, J) shyambihari/- U T
