Mr. DR. AJEET KUMAR ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Chausa P. S. Case no. 142 of 2017 registered for the offences punishable under Section 302 r/w 34 of the Indian Penal Code. Prosecution case is that informant while trying to wake up his wife in the early morning he found her dead. He also found blackish mark around her neck.

It is submitted on behalf of the petitioner that he is not named in the FIR. He and informant are full brothers and due to land dispute he has been implicated in this case. There is no eye witness to the alleged occurrence. He has been made accused in this case only on suspicion. Petitioner has no criminal antecedent. He is in custody since 19.6.2017. It is further submitted that similarly situated co-accused, namely, Dhalo

Patna High Court Cr.Misc. No.6467 of 2018(3) dt.27-02-2018 2/2 Mandal, has been granted anticipatory bail by a Bench of this Court in Cr. Misc. no. 6077 of 2018 and three other accused have been granted regular bail by this Court as contained in Annexure-3 of this petition.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned SDJM, Udakishanganj, Madhepura, in connection with Chausa P.S. Case no. 142 of 2017.
