JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being brother-in-law of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Section 302, 34 of the Indian Penal Code.

It is alleged that sister of the informant was married with one Sanjay Mistri in 2002 and from the wedlock several children were born but subsequently brother-in-law of the informant became mentally disabled and, thereafter, the victim was subjected to torture by her in-law's family members. On 19.01.2015, the informant came to know about death of his sister by burn injury caused by her in-law's family members. It is submitted by learned counsel for the petitioner that admittedly the informant is not an eye witness of the

No.10420 of 2015 (2) dt.23-04-2015 2/2 occurrence and the petitioner was married with the sister of the husband of the victim about 20 years prior to the occurrence and the petitioner is a law practitioner at Saharsa. The victim probably committed suicide due to mental disability of her husband.

It is submitted by learned counsel for the informant that the post-mortem does not suggest that the informant committed suicide.

Considering the fact that accusation is omnibus and general against in-law's family members of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa (Sadar) P.S. Case No.39 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
