2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126 (2), 115 (2), 118 (1), 109 (1), 303 (2), 352, 351 (2), 351 (3) and 3 (5) of the BNS.
3. The case of the prosecution, in short, is that the petitioner along with others assaulted the informant and his brother. There is a specific allegation against the petitioner no. 2 that he assaulted both the brothers with a brick.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.14303 of 2026(3) dt.15-04-2026 2/3 connection with the present case. It is further submitted that the petitioner and informant are co-villagers and there is also a counter version of this case. It is further submitted that from perusal of the injury report, it appears that the informant, namely, Vikash Kumar Jha sustained only simple injuries. So far as his brother, namely, Vikrant Kumar Jha is concerned, he has received three injuries, out of which only one is grievous in nature and that too is on the left hand which falls within the category of bailable in nature. Moreover, the petitioner is languishing in judicial custody since 18.12.2025.
5. Learned counsel appearing on behalf of the informant has vehemently opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Pusa P.S. Case No. 41 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur.
