2. The petitioner seeks bail in connection with Bahadurpur (Patna) P.S. Case No. 295 of 2021, instituted for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

3. The prosecution case, in short, is that, the informant and his friend gave Rs. 10 lakhs to the petitioner for purchase of land. It is further alleged that neither registry of land was done nor the money was returned to them by the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. Learned counsel for the petitioner also submits that earlier the

Patna High Court CR. MISC. No.18967 of 2024(12) dt.14-02-2025 2/3 matter was referred to mediation centre but the dispute between the parties could not be resolved through the process of mediation. No legal notice was issued to the petitioner for bouncing of cheque. It is further submitted that the petitioner had taken loan of Rs. 1 lakh from the informant and he is ready to pay the same to the informant. The petitioner has surrendered in the Court below on 15.01.2025 and has got no criminal antecedent.

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the fact that the petitioner is ready to return an amount of Rs. 1 lakh to the informant, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bahadurpur (Patna) P.S. Case No. 295 of 2021, subject to the following conditions: (I) The petitioner will deposit Rs. 1,00,000/- to the informant within one month after his release from custody.
