The petitioner apprehends his arrest in connection with Barauli P.S. Case No.18 of 2017 registered under Sections 457, 380 and 511 of the Indian Penal Code.

The allegation of the informant is that earlier, on two occasions, theft was committed in his house but no trace of thief was found. On 02.02.2017, one thief tried to entered his house by breaking asbestos of the roof of his house having iron saw and pliers in his hand and when his renter Arun Kumar tried to catch hold of him, he started to flee away, leaving slipper, blade, knife etc. there.

Patna High Court Cr.Misc. No.18097 of 2017 (3) dt.13-07-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner and the informant belong to same mohalla. The house of the informant is on road side and the petitioner used to install 'Chaat'Thela" in front of the house of the informant. There was some hot exchange of words in between the petitioner and the informant, due to that reason, the informant has falsely implicated the petitioner in this case. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Barauli P.S. Case No.18 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
