The petitioners apprehend their arrest in connection with Mahua P.S. Case No. 357 of 2019, registered under Sections 147, 148, 149, 323, 341 and 307 of the Indian Penal Code. The accusation is that 14 persons named in the FIR including the petitioners came at the purchased land of the informant, Renu Singh, who was constructing the house, having armed with lathi, danda and iron rod and made demand of ransom Rs.1,00,000/-, saying that if the ransom amount will not be paid, they will not permit to construct the house in the aforesaid land. When she made protest then Dinesh Singh (petitioner no.1) gave iron rod blow at the head of her son, Nirmal Chandra "Kush" and Sheo Shankar Singh

Patna High Court CR. MISC. No.12754 of 2020(2) dt.01-07-2020 2/2 (petitioner no.2) caused injury through lathi at the head of her brother-in-law, Suresh Singh.

Learned counsel for the petitioners submits that, in fact, occurrence took place due to land dispute, in which, petitioners' side also sustained injury, regarding which, Mahua P.S. Case No. 448 of 2019 was instituted on the basis of Fradebyean of Kiran Devi, wife of petitioner no.1. Moreover, the injuries, as found on the person of son and brother-in-law of the informant, are simple in nature. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 357 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
