ANJANA PRAKASH ORAL JUDGMENT Date: 13-02-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order dated 19.7.2012 passed by the 2nd Additional Sessions Judge, Bhojpur at Ara, in Sessions Trial No. 55 of 2012 arising out of Barahara P.S. Case No. 74 of 2011 by which he has refused to discharge the Petitioner.
Considering that the Petitioner seeks discharge on questions of fact which cannot be gone into at the stage of 482 Cr. P.C., I am not inclined to interfere in the matter. The application stands dismissed.
The Trial Court is directed to conclude the Trial expeditiously without granting unnecessary adjournment to any Party for which reason the Trial Court (2nd Additional Sessions Judge, Bhojpur at Ara) is directed to send a list of the witnesses fixing
Patna High Court Cr.Misc. No.33093 of 2012 dt.13-02-2015 2/2 specific dates for production of the witnesses along with a copy of this order in connection with Sessions Trial No. 55 of 2012 arising out of Barahara P.S. Case No. 74 of 2011, to the Superintendent of Police, Bhojpur at Ara, and the Superintendent of Police, Bhojpur, Ara, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
