The petitioner, who is in custody, seeks bail in connection with Jamui P.S. Case No. 328 of 2017 registered for the offence punishable under Sections 147, 148, 149, 379, 436, 447, 452 of the Indian Penal Code.

Informant is the owner of shop, who in his FIR has stated that on the day of Muharam an arson took place in which battery and other articles kept in his shop was looted by 100 to 150 miscreants and they also set on fire the shop and vehicles standing outside the shop. F.I.R. is against unknown. Petitioner was caught carrying one battery on his motorcycle which was apprehended by the police and he in his confession

Patna High Court Cr.Misc. No.14902 of 2018(3) dt.09-04-2018 2/2 accepted that he had looted this battery from the shop of informant and on the basis of his confession other battery looted by other miscreants were also recovered. It has been submitted on behalf of petitioner that except one looted battery nothing has been further recovered from the possession of petitioner. He has no criminal antecedent and he is in custody since 07.10.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui, in connection with Jamui P.S. Case No. 328 of 2017.
