JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Korhobari P.S. Case No. 37 of 2018, disclosing offences under Sections 147, 148, 149, 323, 325, 307, 379, 448, 504 of the Indian Penal code.
Allegation against the petitioner is of assault to the informant by sharp cutting weapon and also entering into the house of the informant and taking away Rs. 20,000/-. It appears from the para 3 of the petition that petitioner has no criminal antecedent, however, from perusal of the case diary, it appears that petitioner is accused in more case.
Learned counsel for the petitioner is now filing a supplementary affidavit in relation that the petitioner is accused in one more case, however, submission of learned counsel for the petitioner is that allegation is false and concocted and injury

Having heard both sides, in view of the facts and circumstances as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/-(Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Kishanganj, in connection with Korhobari P.S. Case No. 37 of 2018, subject to that condition that laid down under Section 438(2) of the Code of Criminal Procedure.
