The petitioner has preferred this application for grant of regular bail in a case registered under sections 406, 420, 467, 468, 471 and 34 of the Indian Penal Code and sections 66(b) 66(c) of the I.T Act, 2000.
As per the prosecution case, on a raid being conducted three accused persons including the petitioner herein were arrested and it is stated that from possession of the petitioner 14 ATM cards besides other articles from the other accused persons were recovered.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He
Patna High Court CR. MISC. No.25000 of 2021(3) dt.09-12-2021 2/2 is in custody since 28.12.2020 and charge sheet has been submitted. The petitioner has no criminal antecedent. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, charge sheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Kotwali (Jogsar) P.S. Case no. 815 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur.
