The petitioner seeks bail in Singheshwar P.S. Case No. 26 of 2017 registered under Section 379 of the Indian Penal Code.
Motorcycle of the informant is said to have been stolen from his courtyard in the night by some miscreants. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. Nothing incriminating article has been recovered from his conscious physical possession. There is nothing in the case diary indicating the complicity of the petitioner in the occurrence barring his confessional statement. The
Patna High Court Cr.Misc. No.33988 of 2017 (2) dt.20-07-2017 2/2 petitioner has been languishing in custody since 14.04.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. Case No. 26 of 2017.
