The petitioner seeks bail in Sessions Trial No. 17 of 2019 arising out of Amarpur P.S. Case No. 578 of 2017, instituted for the offence under Section(s) 302/34 of the Indian Penal Code.
It is alleged in the written report that co-accused Jatan Tanti, Ratan Tanti and this petitioner assaulted the informant. When the wife of informant came to save him, Jatan Tanti assaulted on her head with lathi, on account of which, she fell down. It is further alleged that when the informant tried to save his wife, he was caught hold by co-accused Hira Tanti from behind and then petitioner along with co-accused Ratan Tanti assaulted wife of the informant indiscriminately.
Patna High Court CR. MISC. No.14516 of 2019(4) dt.29-05-2019 2/2 Subsequently, she died during course of treatment. From the written report it appears that there is specific allegation of assault on the head of wife of informant against Jatan Tanti.
Petitioner is in custody since 6.12.2017 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Banka, in connection with Sessions Trial No. 17 of 2019 arising out of Amarpur P.S. Case No. 578 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
